OVERVIEW
Welcome to Collect African Art. The terms "we", "us" and "our" refer to Collect African Art, operated by The Akari Group LLC, a Delaware limited liability company. Collect African Art represents the African art continuum — the unbroken flow of creativity across time, geography, and medium.
Collect African Art is powered by Shopify, which enables us to provide our store and services to you.
The Akari Group LLC operates in Ghana through its affiliated entity The Akari Group Limited (Ghana), which acts as the LLC's agent for shipping coordination, local operations, and artist relations in Ghana. All contracts are with The Akari Group LLC.
By visiting, browsing, or purchasing from our store, you ("Buyer," "you") agree to be bound by these Terms of Service. If you do not agree, you may not use our store.
SECTION 1 — ACCEPTANCE OF TERMS
By accessing or purchasing from Collect African Art, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use our store on devices you own, purchase, or manage.
You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide this information.
Collect African Art reserves the right to modify these Terms at any time. Changes will be posted with an updated "Last Updated" date. Continued use of the store after modifications constitutes acceptance of the updated Terms. Material changes will be communicated via email to recent buyers.
SECTION 2 — OUR PLATFORM & PRODUCTS
Collect African Art is a curated online gallery presenting African art and cultural objects — spanning contemporary fine art, traditional craft, and significant cultural works by African and diaspora artists.
Items are available for direct purchase or, where indicated, by enquiry. Some works require the submission of an enquiry form prior to purchase — see Section 3A for the enquiry process.
All transactions are managed directly by Collect African Art.
We have made every effort to accurately represent our products. However, colours and product appearance may differ from how they appear on your screen due to your device and display settings. We do not warrant that the appearance or quality of any product will meet your expectations or match depictions in our store exactly.
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time.
SECTION 3 — ORDERS & PAYMENT
When you place an order, you are making an offer to purchase. Collect African Art reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Collect African Art confirms acceptance. Payment is processed immediately upon order completion.
By providing payment information, you authorise Collect African Art to charge the total amount due, which includes the artwork price, shipping costs, insurance costs (where applicable), and any applicable taxes.
All transactions are processed in USD. Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation.
You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are authorised to use the payment method provided; and (iii) you will pay all charges incurred, including shipping, handling, and applicable taxes.
In the event of an honest pricing error, Collect African Art reserves the right to cancel the order and issue a full refund.
Please review your order carefully before submitting. Collect African Art may be unable to accommodate cancellation requests after an order has been accepted. Orders may be cancelled before shipping begins for a full refund. Once shipped, the standard return policy applies.
Your purchases are subject to return or exchange solely in accordance with our Return & Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 3A — ENQUIRY PROCESS
Some works presented on Collect African Art are designated as available by enquiry only. These works are marked accordingly in the listing. To express interest in an enquiry-only work, you must complete and submit the enquiry form on the relevant product page.
The following terms govern the enquiry process:
3A.1 Submission Does Not Constitute an Order or Reservation
Submitting an enquiry form does not constitute a purchase, an offer to purchase, or a reservation of the work. The work remains available to other interested buyers until a formal order is confirmed and payment is received.
3A.2 Response Timeframe
Collect African Art will respond to all submitted enquiries within 48 hours during business days. Response times may vary during public holidays or periods of high volume. Collect African Art is not obligated to proceed with any enquiry and reserves the right to decline without explanation.
3A.3 Pricing Discussed During Enquiry
Any pricing, condition information, or terms discussed during the enquiry process are provided for informational purposes only and are not binding on either party until a formal order is confirmed in writing by Collect African Art and payment is received in full.
3A.4 Accurate Information
You must provide accurate and complete information in any enquiry form submission. Collect African Art is not responsible for failure to respond or process an enquiry resulting from incorrect or incomplete contact information.
3A.5 No Obligation on Either Party
Neither the submission of an enquiry nor Collect African Art's response creates any binding obligation on either party. Collect African Art retains full discretion over whether to proceed with any sale.
SECTION 4 — ACCOUNTS
Collect African Art does not require user accounts. All purchases may be completed via guest checkout. Buyers receive order confirmations and tracking information directly by email.
Note: Shopify, which powers our store, may offer optional customer account functionality. If you choose to create a Shopify account, you are solely responsible for maintaining the security of your account credentials and all account activity.
SECTION 5 — SHIPPING & DELIVERY
Collect African Art arranges and manages all shipping logistics. Shipping costs are calculated at checkout based on destination and artwork specifications. Buyers receive tracking information by email once shipments are dispatched.
Estimated delivery times provided at checkout are estimates only and are not guaranteed. We are not liable for shipping and delivery delays. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.
For international orders, import duties, customs fees, and taxes are the buyer's responsibility. Collect African Art is not liable for customs delays or seizures. Buyers must comply with all import regulations in their jurisdiction.
The courier may require a signature upon delivery. The 72-hour return window begins at the time of your signed delivery confirmation.
Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 6 — RETURNS & REFUNDS
IMPORTANT: You must inspect your order immediately upon delivery. The return and damage reporting window is 72 hours from the time of your signed delivery confirmation. Claims submitted after this window will not be accepted.
Reporting Damage or Defects
Any damage, defects, or discrepancies must be reported to Collect African Art within 72 hours of signing for delivery, with photographic evidence from multiple angles. If the outer packaging appears damaged upon arrival, please note this on the delivery receipt and photograph it before opening.
Return Window — Within 72 Hours
If you contact Collect African Art within 72 hours of signing for delivery, returns are accepted for any reason, provided that:
- You provide photographic evidence (multiple angles) of the item and packaging
- You pay return shipping costs to Ghana
- The item is returned in the same condition as delivered, with original packaging
Collect African Art will provide a return shipping address. Refunds are issued upon receipt and inspection of the returned item.
Returns After 72 Hours
After the 72-hour window, returns are accepted only if the item is materially different from its description (wrong artwork or wrong item shipped), or the item is damaged and you hold photographic proof taken within 72 hours of delivery. Return requests submitted after 72 hours are subject to Collect African Art's sole discretion.
Authenticity Claims
Authenticity disputes must be raised within 72 hours of delivery with supporting photographic evidence. All sales are considered final with respect to authenticity after this period.
Value Disputes
If you believe an item is not worth the stated price, you must submit a written claim within 72 hours of delivery. Collect African Art will review the claim at its sole discretion. The maximum refund in such cases is 50% of the purchase price. This decision is final and binding.
Refund Processing
Approved refunds are processed within 15 working days of Collect African Art's receipt and inspection of the returned item, to your original payment method.
Case-by-Case Discretion
Collect African Art reserves the right to address exceptional circumstances on a case-by-case basis but is not obligated to accept returns outside the stated policy. For full details, please refer to our Return & Refund Policy.
SECTION 7 — HIGH-VALUE PURCHASES ($1,000+)
For purchases of $1,000 USD or more, buyers may request additional photographs, a video call to view the artwork, or additional condition reports. Requests must be made before purchase completion. Collect African Art will accommodate reasonable requests within 48 hours.
All items valued at $1,000 USD or more are automatically insured by Collect African Art against loss or damage during transit at no additional cost. For items valued below $1,000 USD, optional additional insurance coverage may be available — please enquire via the contact form at www.collectafrican.art for details prior to purchase.
SECTION 8 — RELATIONSHIP WITH SHOPIFY
Collect African Art is powered by Shopify, which enables us to provide our store and services to you. However, any sales and purchases you make in our store are made directly with Collect African Art. By using our store, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Collect African Art, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Collect African Art.
SECTION 9 — INTELLECTUAL PROPERTY
All content on the Platform — including text, images, logos, design, software, and editorial content — is the property of The Akari Group LLC or its licensors. Unauthorised use is prohibited.
Users may not download, reproduce, copy, distribute, or create derivative works from any images or content on the Platform without express written permission.
Artist Copyright & Reproduction Rights
Artists retain full copyright in all their works. Purchase of artwork conveys ownership of the physical artwork only. Copyright and all reproduction rights remain with the Artist unless explicitly transferred in a separate written agreement signed by both Artist and Buyer.
What Buyers May Do
- Display, photograph, and enjoy the physical artwork
- Include the artwork in personal photography or documentation of your collection
- Resell the physical artwork (subject to resale royalty obligations for Exclusive Artists — see below)
- Display photographs of your artwork on personal social media with appropriate artist credit
What Buyers May NOT Do
- Reproduce the artwork for commercial purposes
- Create prints, posters, or merchandise featuring the artwork
- License or sell reproduction rights to third parties
- Remove, alter, or obscure the artist's signature or attribution
- Create derivative works based on the artwork
- Use artwork images for advertising, marketing, or commercial purposes without the Artist's written permission
Unique/One-of-a-Kind Works
Artworks specifically designated and sold as "Unique/One-of-a-Kind" will be clearly marked in the listing and Certificate of Authenticity. For these designated works only, the Artist agrees not to create reproductions or editions without your written consent.
Resale Royalty Rights (Exclusive Artists Only)
Artist profiles clearly indicate whether an artist is represented under "Exclusive Representation" terms. For artworks purchased from Exclusive Represented Artists, if you resell the artwork through any channel, you agree to:
- Pay the original Artist five percent (5%) of the gross resale price within 30 days of completing the resale
- Notify Collect African Art at www.collectafrican.art (contact form) and the Artist in writing within 30 days of the resale, providing the sale price, buyer contact information, date of sale, and proof of sale
- Inform any future buyer of this continuing resale royalty obligation and include it in any bill of sale or transfer documents
This obligation runs with the artwork for its lifetime and applies to all subsequent owners. Works purchased from Non-Exclusive or Marketplace Artists are not subject to any resale royalty. This is a contractual obligation you accept at the point of purchase. Breach may result in legal action by the Artist or Platform.
Licensing Requests
To license reproduction rights or use artwork images for commercial purposes, contact www.collectafrican.art (contact form). Collect African Art may assist in negotiations but is not a party to such agreements.
DMCA Compliance
Collect African Art complies with the Digital Millennium Copyright Act. Copyright infringement claims should be sent to www.collectafrican.art (contact form). All artwork images on the Platform are watermarked or digitally protected. Unauthorised removal of watermarks or misuse of images constitutes copyright infringement and may result in legal action.
SECTION 10 — PRIVACY & DATA
All personal information we collect is subject to our Privacy Policy.
Because our store is hosted by Shopify, Shopify also collects and processes personal information about your access to and use of our store. Information you submit may be transmitted to and shared with Shopify as well as third parties. Please review Shopify's Privacy Policy for details.
Collect African Art collects only the information necessary to process your order: name, email, shipping address, and payment details. This information is used solely to fulfil orders, provide customer service, and send transactional communications. We will not use your information for marketing purposes without your explicit consent.
Payment processing may be handled by third-party services (e.g., Stripe, PayPal). These services have their own privacy policies.
With explicit consent, Collect African Art may send curated updates about cultural events and platform announcements. You may unsubscribe at any time.
SECTION 11 — THIRD-PARTY LINKS & TOOLS
Our store may contain links to third-party websites or offer access to third-party tools. We are not responsible for examining or evaluating the content or accuracy of third-party materials. If you leave our store to access third-party content, you do so at your own risk. We are not liable for any harm or damages related to your use of any third-party websites, tools, products, or services.
SECTION 12 — BUYER OBLIGATIONS & PROHIBITED CONDUCT
Buyers must provide accurate shipping, billing, and contact information.
Buyers may not:
- Engage in fraudulent transactions or payment disputes without legitimate cause
- Harass, threaten, or abuse Collect African Art staff or artists
- Attempt to circumvent Platform processes or contact artists directly for sales
- Use the store for money laundering or illegal activities
- Submit false claims regarding item condition or authenticity
If a buyer contacts an artist directly (bypassing the Platform) for any transaction or dispute, Collect African Art is not responsible for any issues, damages, or disputes arising from such direct dealings.
SECTION 13 — COMMENTS & USER-GENERATED CONTENT
Collect African Art may offer commenting features on content published on the platform. Commenting is a privilege, not a right, and may be disabled at any time.
Note: Commenting is only available where enabled through our platform. If you do not see a commenting feature, it may not be active on your device or region.
Users who post comments agree to engage respectfully, refrain from harassment, hate speech, or discriminatory language, not post spam or promotional content, and not use comments to arrange transactions outside the Platform.
The following content is strictly prohibited: hate speech, harassment, sexually explicit content, spam, false claims about artists or artworks, and content that violates any law or regulation.
Collect African Art reserves the right to monitor, edit, or remove any comment at any time without notice. Comments represent the views of individual users, not Collect African Art.
By posting a comment, you grant Collect African Art a non-exclusive, perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, publish, and display your comment in connection with the Platform. You are solely responsible for your comments and agree to indemnify The Akari Group LLC from any claims arising from them.
Users may report violations to www.collectafrican.art (contact form).
SECTION 14 — FEEDBACK
If you submit ideas, suggestions, feedback, or reviews, you grant Collect African Art a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and display such feedback for any purpose, including to operate and improve our store. We are under no obligation to maintain feedback in confidence, pay compensation for it, or respond to it.
SECTION 15 — ERRORS, INACCURACIES & OMISSIONS
There may occasionally be information in our store that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and to cancel orders if any information is inaccurate at any time without prior notice.
SECTION 16 — DISCLAIMER OF WARRANTIES
All artwork and items are sold "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by law.
Collect African Art makes no representations regarding the investment value, future appreciation, or resale potential of any artwork. Art purchases should be made for aesthetic and cultural enjoyment, not financial speculation.
Collect African Art does not guarantee the Platform will be available at all times or free from errors or interruptions.
Some jurisdictions do not allow the disclaimer of implied warranties, so the above may not apply to you in full.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Collect African Art, The Akari Group LLC, our affiliates, officers, employees, agents, contractors, and service providers — or those of Shopify and its affiliates — shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of our store or any products purchased through it.
Collect African Art's total liability for any claim relating to a specific purchase shall not exceed the purchase price paid by the buyer for that item.
Collect African Art is not liable for the actions, errors, or omissions of third-party service providers including payment processors, shipping couriers, or insurance companies.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Collect African Art, The Akari Group LLC, Shopify, and our affiliates, partners, officers, directors, employees, and agents from any losses, damages, liabilities, or claims — including reasonable legal fees — arising from: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of our store.
SECTION 19 — FRAUD PREVENTION
Collect African Art reserves the right to refuse or cancel any order at any time, including for suspected fraudulent transactions, unusual order patterns, incorrect information, or high-risk shipping destinations. Collect African Art may request additional verification for high-value purchases.
SECTION 20 — TERMINATION
We may terminate this agreement or your access to our store at any time without notice. You will remain liable for all amounts due up to the date of termination. Sections relating to Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and Privacy will survive termination.
SECTION 21 — GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of Ghana without regard to conflict of law principles. The Akari Group LLC submits to the jurisdiction of Ghana for purposes of these Terms.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved through binding arbitration in Accra, Ghana under the Ghana Arbitration Act before any court proceedings. Arbitration is administered by the Ghana Arbitration Centre or a mutually agreed arbitrator. Arbitration costs are split equally between parties. Each party bears its own legal fees. The arbitrator's decision is final and binding.
Disputes must be brought on an individual basis. Class actions, class arbitrations, or representative actions are not permitted.
Note for international buyers: Consumer protection laws in your jurisdiction (including EU and UK law) may provide you with rights that apply regardless of this governing law clause. Nothing in these Terms is intended to limit any statutory rights you may have under applicable local law.
SECTION 22 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed. This shall not affect the validity and enforceability of any remaining provisions.
SECTION 23 — WAIVER & ENTIRE AGREEMENT
Failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Shipping Terms & Conditions, and Return & Refund Policy, constitute the entire agreement between you and Collect African Art and govern your use of our store, superseding any prior agreements.
SECTION 24 — ASSIGNMENT
You may not delegate, transfer, or assign these Terms or any of your rights or obligations without our prior written consent. Collect African Art may assign these Terms upon a business sale or transfer.
SECTION 25 — CHANGES TO TERMS
You can review the most current version of these Terms at any time on this page. We reserve the right to update or replace any part of these Terms by posting changes to our website. Your continued use of our store following any changes constitutes acceptance of those changes.
